Summit Dental AI provides marketing, creative, and content production services to dental practices. Summit Dental AI is not a healthcare provider and does not provide diagnosis, treatment, or clinical advice.

1. Client Responsibility for Authorizations

The client dental practice is solely responsible for obtaining all patient authorizations, releases, and consents required under applicable federal and state law before transmitting any photographs, videos, treatment information, testimonials, or related materials to Summit Dental AI.

2. Minimum Necessary Standard

The client agrees to limit submissions to only those materials reasonably necessary for the requested marketing services. Whenever possible, the client should remove unnecessary identifiers before submission.

3. Permitted Use of Submitted Materials

Summit Dental AI will use submitted materials only for the purpose of providing contracted content production, editing, planning, and related marketing services requested by the client, unless otherwise agreed in writing.

4. No Independent Verification

Summit Dental AI may rely on the client's representation that valid patient authorization has been obtained. Summit Dental AI does not independently verify the sufficiency of each patient release or HIPAA authorization unless expressly engaged to do so in writing.

5. Security and Storage

Summit Dental AI will use commercially reasonable safeguards for the handling and storage of submitted materials.

6. Business Associate Agreement

If the parties determine that Summit Dental AI will create, receive, maintain, or transmit protected health information on behalf of the client in a manner requiring a Business Associate Agreement, the parties agree to execute a separate written BAA before such activity begins.

7. Facial Privacy Standard

When full facial video or photographic content is produced, Summit Dental AI limits visible patient facial features to no more than two-thirds (2/3) of the face in any publicly distributed material, unless explicit written full-face authorization has been obtained and is on file with the client practice. This standard is applied during post-production as a default privacy safeguard.

8. Client Review Before Publication

The client is responsible for final review and approval of all marketing content before publication, distribution, or advertising use.

9. No Legal Advice

Nothing on this website constitutes legal advice. The client should consult qualified healthcare privacy counsel regarding HIPAA, state privacy law, informed consent, advertising law, and patient authorization requirements.
